Abstract
The role of the Public Prosecutor's Office in hearings within the context of Brazilian civil procedure is a topic of significant legal relevance, especially in light of the transformations brought about by the 2015 Code of Civil Procedure, which consolidated a cooperative procedural model focused on the effectiveness of judicial protection. This research is justified by the need to understand the role played by the Public Prosecutor's Office in hearings, a central space for the production of evidence and the construction of judicial decisions, as well as its contribution to guaranteeing fundamental rights. In this context, the following research question was established: how does the role of the Public Prosecutor's Office in hearings contribute to the effectiveness of judicial protection and the guarantee of fundamental rights? The general objective was to analyze this role, while the specific objectives sought to identify its functions in hearings, examine its relevance to the adversarial system and due process of law, and evaluate its impact on the quality of judicial decisions. Methodologically, a literature review was adopted, based on doctrinal works and scientific articles published in the last five years, consulted in databases such as Google Scholar, SciELO, and Portal CAPES, using specific keywords related to the topic. The analysis of the results showed that the Public Prosecutor's Office's actions contribute significantly to procedural balance, to the expansion of legal debate, and to the effectiveness of judicial protection, especially in cases involving non-disposable interests. It is concluded that its participation in hearings is essential for the construction of fairer, more well-founded decisions aligned with constitutional principles, reaffirming its importance in the Brazilian justice system.
